Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Trinco, an AI-powered sales copilot ("Service") operated by Nanthi Ventures Inc., an Ontario corporation ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@trinco.io if you suspect unauthorized access.

You may not share your account with others or create accounts for the purpose of abuse or circumventing limits.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to send spam, conduct phishing, or distribute malware
  • Resell or sublicense the Service without our prior written consent
  • Upload content that infringes intellectual property rights of others

4. Your data

You retain ownership of all data you input into Trinco ("Your Content"). You grant us a limited, non-exclusive licence to store, process, and display Your Content solely to provide the Service to you.

We will not use Your Content to train AI models or share it with third parties except as required to operate the Service (e.g., passing prompts to our AI provider) or as required by law.

5. Fees and payment

Trinco is currently in early access. We will provide reasonable notice before introducing paid plans or changing pricing. If you are on a paid plan, fees are due in advance and are non-refundable except as required by applicable law or as described in our refund policy.

6. Intellectual property

The Service, including its software, design, trademarks, and content (excluding Your Content), is owned by Nanthi Ventures Inc. and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will be accurate.

AI-generated insights and suggestions are for informational purposes only and do not constitute professional sales, financial, or legal advice.

8. Limitation of liability

To the maximum extent permitted by applicable law, Nanthi Ventures Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the fees you paid to us in the 12 months preceding the claim, or (b) CAD $100.

9. Indemnification

You agree to indemnify and hold harmless Nanthi Ventures Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access for violation of these Terms, non-payment, or if we discontinue the Service, with reasonable notice where practicable. Upon termination, your right to use the Service ends immediately.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the product at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
